It was made for Sony Home Entertainment's 15th anniversary edition DVD release of the 1993 film, "Groundhog Day." It was filmed on location at the silver mining ghost town of Gothic, Colorado, near Crested Butte. The Rocky Mountain Biological Laboratory has been located there since its founding in 1928.

On June 3, 1973, a man was murdered in a busy intersection of San Francisco’s Chinatown as part of an ongoing gang war. Chol Soo Lee, a 20-year-old Korean immigrant who had previous run-ins with the law, was arrested and convicted based on flimsy evidence and the eyewitness accounts of white tourists who couldn’t distinguish between Asian features. Sentenced to life in prison, Chol Soo Lee would spend years fighting to survive behind bars before journalist K.W. Lee took an interest in his case. The makers claimed that 'Old Media' documentary crews couldn't understand the internet culture that filesharers took part in, and that they saw peer-to-peer organization as a threat to their livelihoods. Because of that, they were determined to accurately represent the filesharing community from within. Notably, Steal This Film was released and distributed, free of charge, through the same filesharing networks that the film documents.
